Maude & Miller complies with the New Zealand Privacy Act 2020 when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

Maude & Miller will only collect personal information that is connected to a function or activity we carry out, and only where the collection of that information is necessary for that function or activity. Maude & Miller collects information about you for the purposes listed below.

Maude & Miller is required to collect personal information about you to meet New Zealand and overseas legal obligations (i.e. protecting your money, and assisting in preventing fraud and money laundering). It is important we keep our information about you up-to-date. Please tell us as soon as possible if your contact details or other information you have given us has changed.

If you do not provide personal information that we have requested, you may not be able to obtain or access the services for which the personal information is required.

Who do we collect your personal information from?

We collect personal information about you from:

  • you, via our website and any related service, through any registration process OR through any contact with us (e.g. telephone call, email or post), when you ask for our services, and during our relationship with you;

  • third parties where you have authorised this or the information is publicly available. 

We may also make enquiries of others to verify the information you provide to us. Where possible, we will collect personal information from you directly.

  • to protect and/or enforce our legal rights and interests, including defending any claim;

  • for any other purpose authorised by you or the Privacy Act;

  • to comply with any laws in New Zealand or overseas applying to us or the accounts or services we provide you.

Disclosing your personal information

We may disclose your personal information to:

  • any business that supports our accounts and services, including any person that hosts or maintains any underlying IT system or data centre that we use to provide our database, website, disaster recovery services or other services;

  • a credit reference agency for the purpose of credit checking you;

  • our/your insurers in relation to money you owe us;

  • our assignees or potential assignees;

  • anyone we need to contact to carry out your instructions to us (including the recipient of any payment);

  • anyone authorised by the Privacy Act or another law (e.g. a law enforcement or regulatory agency, IRD, our Bank regarding Foreign Account Tax Compliance Act or Common Reporting Standard obligations, the Anti-Money Laundering and Countering Financing of Terrorism Act, the Financial Markets Authority, and other Government agencies);

  • any other person authorised by you.

After you cease to be a client, we will no longer use your personal information unless authorised to by you, or required to by law.

Protecting your personal information

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or disclosure. The computers/servers in which we store personal information are kept in a secure environment.

Accessing and correcting your personal information

Subject to the Privacy Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.
